Cain, Terrence, Cause for Concern or Cause for Celebration?: Did Bostock v. Clayton County establish a new mixed motive theory for Title VII cases and make it easier for plaintiffs to prove discrimination claims?, 45 Seattle University Law Review (2021).

Bostock articulated a theory of “but for” causation that allows plaintiffs with mixed motive Title VII claims to receive the full panoply of Title VII remedies rather than the limited relief that was available in mixed motive cases prior to Bostock.

Banks v. Hawkins, Prevailed on appeal, 19-3092, United States Court of Appeals for the Eighth Circuit (May 27, 2021).

The United States Court of Appeals for the Eighth Circuit affirmed the trial court’s denial of a police officer’s assertion of qualified immunity in a Fourth Amendment excessive force case. The Court also held that the officer violated clearly established law when he shot an unarmed, non-aggressive man who posed no immediate threat to anyone.

Hunt Memorial Cathedral of Faith & West Dumas Church of God in Christ v. Union Bank & Trust Company, Attorney for the Appellants, CV-20-198, Arkansas Court of Appeals (February 10, 2021).

The Arkansas Court of Appeals reversed a trial court order entering a default judgment against two churches. The appellate court ruled that the default judgment was void because the trial court entered it sua sponte and in the absence of the plaintiff filing a motion requesting it.

Professor Cain discussed the proliferation of law enforcement鈥檚 use of license plate reading technology and what impact, if any, Riley v. California, 573 U.S. 373 (2014) and Carpenter v. United States, 138 S. Ct. 2206 (2018) may have on the constitutionality of the use of that technology in the absence of a search warrant.
